At ProTunes One, we take your privacy seriously and handle your personal data with care. On this page, we'll explain exactly what we do (and don't do) with the information you provide to us.
Section 1: Information on the collection of personal data
(1) We provide information in the following on the collection of personal data during the use of our platform protunesone.com. Personal data are all data that relate to you personally, such as your name, address, email addresses and user behaviour.
(2) The controller, as defined by Art. 4, para. 7 of the EU General Data Protection Regulation (GDPR) is ProTunes Europe GmbH, Bergmannstraße 21, 01309 Dresden, Germany, Email: [email protected] (see our imprint) and represented by Declan Mohan.
(3) When you contact us by email, chat, telephone, or via a contact form, we will store the data you share with us (your email address and possibly your name and phone number) in order to respond to your questions as well as to be able to provide you with the best possible service in the future. We will erase data obtained in this respect once storage is no longer necessary, or we will restrict the processing of such data where statutory safe-keeping obligations apply. By submitting a query, you grant us your consent to data processing in accordance with Art. 6 para 1 lit. a GDPR.
Section 2: Your rights
(1) You have the following rights regarding our use of the personal data that relates to you:
– The right to information
– The right to rectification and deletion
– The right to restriction of processing
– The right to object to the processing
– The right to data portability
(2) In addition, you have the right to file a complaint with a data protection supervisory authority concerning our processing of your personal data.

Section 3: Data collection, processing and use
When using the ProTunes One Service (hereinafter the Service) we will collect and process the following data:
a. Registration Data: your first and your last name, your email-address and a password chosen by you.
b. Contract Data: your first name, your last name, your email-address, your customer ID, the sign-up date, the audio files downloaded by you, the subscriptions entered by you, the social media channels chosen by you and your payment data.
c. Usage Data: the date of your last login, your text searches within the service, the audio files played by you within the Service.
d. Support Data: your email-address, your first and last name as well as the information you provide during the support request.
e. Cookies: data records that are sent from the web server to the user's browser and stored there for later retrieval. We use both session cookies and permanent cookies.
Section 4: Registration Data
(1) The use of the Service requires a registration at ProTunes. By this registration you enter into an agreement with ProTunes. During the registration process you will be requested to enter the Registration Data.
(2) ProTunes will use the Registration Data (see Section 3.a) only for the purpose of rendering the Service unless otherwise specified in this Declaration. The legal basis for the collection and processing of such data is to perform the contract (Art. 6 para 1 lit. b GDPR). Such data will be stored for up to 10 years after the end of the contractual relationship.
Section 5: Contract Data
(1) ProTunes will use the Contract Data (see Section 3.b) only for the purpose of managing and executing the concluded contracts. In particular we will use the data about your subscriptions, your downloaded audio files and the list of social media channels to fulfill our contractual obligations.
(2) The legal basis for the collection and processing of such data is to perform the contract (Art. 6 para 1 lit. b GDPR). Such data will be stored for up to 10 years after the end of the contractual relationship.
(3) We use service providers such as payment service providers.. Your personal data is processed on our behalf on the basis of order processing contracts pursuant to Article 28 GDPR. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR.
(4) If data is transferred to recipients outside the European Economic Area, it is only transferred to countries for which the EU Commission has issued an adequacy decision in accordance with Article 45 GDPR. If an adequacy decision is not available for a country, standard data protection clauses are concluded with the respective recipient in accordance with Article 46 para. 2 c GDPR.
Section 6: Usage Data
(1) ProTunes will use the Usage Data (see Section 3.c) to analyze your needs and your behaviour in order to adapt, improve and enhance the Service.
(2) The legal basis for the collection and processing of such data is our legitimate interest (development and adaptation of the Service to user needs (Art 6 para 1 lit f. GDPR). Such data is deleted as soon as it is no longer necessary for analysis.
Section 7: Support Data
(1) ProTunes will use the Support Data (see Section 3d) to provide you with customer support. The processing of this data serves to simplify communication with you, to answer and solve your queries more quickly, to track the chat history, and to constantly monitor the quality of support service. By using the support service or sending an e-mail to the support service, you consent to the processing of the data. If you no longer wish this to be the case, you can request the deletion of the data in writing at any time.
(2) The legal basis for the collection and processing of such data is the fulfilment of contract (Art. 6 para. 1 b. GDPR), and our legitimate interests (Art. 6 para. 1 f. GDPR). The legitimate interest lies in ensuring user-friendly communication. Such data will be deleted after the support is fulfilled.
(3) We may use third parties to provide services like desktop service for user-friendly communication. our personal data is processed on our behalf on the basis of order processing contracts pursuant to Article 28 GDPR. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR.
(4) If data is transferred to recipients outside the European Economic Area, it is only transferred to countries for which the EU Commission has issued an adequacy decision in accordance with Article 45 GDPR. If an adequacy decision is not available for a country, standard data protection clauses are concluded with the respective recipient in accordance with Article 46 para. 2 c GDPR.
Section 8: Cookies
ProTunes uses so-called cookies. Cookies are small text files that are usually stored in a folder of your browser. Cookies contain information about the current or last visit to the website:

Expiry date of the cookie
Any value
If cookies do not contain an exact expiry date, they are only temporarily stored and automatically deleted as soon as the user closes the browser or restart the end device. Cookies with an expiry date remain stored even if the user closes the browser or restart the end device. Such cookies are only removed on the specified date or when you delete them manually.
ProTunes uses the following three types of cookies on our website:
Necessary cookies (ProTunes needs these, for example, to display the website correctly for you and to temporarily store certain settings).
Functional and performance-related cookies
Advertising and analysis cookies.
The user can configure, block and delete cookies in his/her browser settings. If the user deletes all cookies from ProTunes, some of the functions may not be displayed correctly.
With the exception of the technically necessary cookies, the other types of cookies are only activated after express consent has been given. This consent can be revoked at any time. The User can find the revocation option and further information in the cookie settings.
Section 9: Newsletter
(1) ProTunes offers the service to receive new information about the Service via a Newsletter. For that purpose, ProTunes will use your first name and your last name, your email-address and your newsletter registration.
(2) You actively provide us with this data when you register for the newsletter so that the Newsletters will only be sent with your consent in accordance with Art. 6 para 1 a. GDPR.
(3) Your data will remain stored as long as you are subscribed to the newsletter. As soon as you unsubscribe from the newsletter (e.g. via the link provided in the newsletter), your data will be deleted.
(4) If data is transferred to recipients outside the European Economic Area, it is only transferred to countries for which the EU Commission has issued an adequacy decision in accordance with Article 45 GDPR. If an adequacy decision is not available for a country, standard data protection clauses are concluded with the respective recipient in accordance with Article 46 para. 2 c GDPR.
Section 10: User Surveys
(1) ProTunes may conduct user surveys in order to analyze the needs of the users and to further adapt the Service. Participation in the surveys is voluntary. When registering, you have the option of providing your contact data for contacting and conducting the user survey. This information is provided voluntarily. You can also register with us if you do not want to provide your data.
(2) The legal basis for the processing is Art. 6 para. 1 lit. a GDPR. You can revoke this consent at any time with effect for the future. However, this revocation does not affect the lawfulness of the data processing that took place until the time of the revocation.

Section 11: YouTube
ProTunes One is using YouTube API Services to provide channel clearance and allowlist support. For more information on Google and YouTube's privacy policy, you may review at https://policies.google.com/privacy You can revoke ProTunes One's access to your data via the Google security settings by visiting https://myaccount.google.com/security.
Section 12: Hosting
The Service is hosted by service providers. There is no transfer of such data to recipients outside the European Economic Area. Your personal data is processed on our behalf on the basis of order processing contracts pursuant to Article 28 GDPR. In these cases, we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR.
If data is transferred to recipients outside the European Economic Area, it is only transferred to countries for which the EU Commission has issued an adequacy decision in accordance with Article 45 GDPR. If an adequacy decision is not available for a country, standard data protection clauses are concluded with the respective recipient in accordance with Article 46 para. 2 c GDPR.
Section 13: Objecting or withdrawing consent to the processing of your data
(1) If you have consented to the processing of your data, you may withdraw your consent at any time. Such a withdrawal of consent will affect the reliability of the processing of your data after you have sent us the declaration of your withdrawal.
(2) To the extent that we process your data on the basis of legitimate interests, you may object to the processing of your data. This is the case, if the processing is not specifically necessary for the fulfillment of a contract, which is indicated by us in each case in the description of functions above. When submitting such an objection, please explain the reasons why we should not process your personal data in the manner implemented by us. In the event of a justified objection, we will review the facts and either cease/adapt the processing of your data or demonstrate our compelling legitimate grounds, on the basis of which we will continue to process the data.
